Thank you for the very meaningful evidence I've been looking for; and the redirection needed to help build my case. Unfortunatly I live in an area that doesn't produce seasoned attorny's; so I'm fighting an uphill battle.

Any passive increase to a pension that occurs during marriage, where the principal contributions occurred entirely prior to marriage, is still considered separate property of the contributing spouse.

Conversely, any active increase to a pension (employee/employer contributions and market increase during the period of contribution) would be considered community property. These of course are general rules, the specifics vary with each case.

With respect to the home, it would contain both separate and community property elements. There is a complicated formula used to determine the community and separate property interests, but as a general rule, the value of the pay down and increase in value that occurs during marriage creates a community property interest, but does not make the entire value of the home community property. Sorry about the delay in responding, hope this information helps.

I read somewhere it said in some jurisdictions, any increases of the previous owned assets (such as a pension) during the marriage is community property. Is it true? What about a house? It is under my spouse name before we married, but once we married, we paid the mortgage together for more than 9 years. Is it community property?

As a mandated rpoerter I and many others I have worked with often find it frustrating at how many reports we have to make before we can get the wheels moving to assist children and families. I would like to see better collaboration between mandated rpoerters and the child support enforcement. The caseloads clearly are overwhelming and unrealistic which makes it very difficult to get the level of attention that is needed. Better collaboration could help spread the load and avoid duplication of work.
